End-User Licence Agreement (EULA)

This End-User Licence Agreement ('Agreement') governs the use of the dvgtime software, including its extension for Microsoft Dynamics 365 Business Central and its cloud platform, owned by DAVISA INFORMÁTICA S.L. ('DAVISA'). By installing, activating or using dvgtime, the customer accepts this Agreement.

1. Licence grant

DAVISA grants the customer a non-exclusive, non-transferable and revocable licence to use dvgtime in accordance with the contracted subscription, for its duration and for the customer's internal workforce management purposes.

3. Intellectual property

dvgtime, its code, trademarks and documentation are the property of DAVISA. The customer retains ownership of their own data.

4. Customer data

The processing of personal data is governed by the Privacy Policy. Each customer operates in an isolated environment and is responsible for the data they input.

5. Availability and support

DAVISA will make reasonable efforts to ensure service availability and will provide support in accordance with the contracted plan. Specific service levels are detailed in the subscription agreement.

6. Warranties and liability

The software is provided 'as is'. To the maximum extent permitted by law, DAVISA's liability is limited to the amount paid by the customer in the twelve months preceding the event giving rise to the claim. DAVISA is not liable for indirect damages or loss of profits.

7. Term and termination

The Agreement is in force for the duration of the subscription. Upon termination, the customer may export their data during a reasonable period, after which it will be deleted in accordance with the privacy policy.

8. Governing law

This Agreement is governed by Spanish law. For any dispute, the parties submit to the courts of DAVISA's registered address, unless mandatory law provides otherwise.
